Granny flats (officially called secondary dwellings in NSW planning law) are self-contained dwellings built on the same lot as an existing principal dwelling. NSW has some of the most permissive granny flat rules in Australia, making them a popular strategy for rental income, family accommodation, or adding property value.
Since the NSW Affordable Rental Housing SEPP (now incorporated into the Housing SEPP 2021), granny flats can be built on most residential lots across NSW — including R2 Low Density Residential zones. This means nearly every detached house in Western Sydney can potentially add a granny flat.
Maximum Size and Design Rules
Key granny flat rules in NSW:
• Maximum floor area: 60sqm (internal living area) • Minimum lot size: 450sqm (to add a granny flat) • Maximum height: 8.5m (pitched roof) or 3.8m (flat roof, single storey) • Must be self-contained: own kitchen, bathroom, living, and bedroom • Maximum 2 bedrooms • Cannot be separately subdivided from the principal dwelling (Torrens title not available for granny flats) • Must be on the same lot as a principal dwelling • Only one granny flat per lot
**Setback requirements:** • Front setback: Behind the building line of the principal dwelling • Side setback: 900mm minimum • Rear setback: 3m minimum (or as specified by council DCP)

CDC vs DA for Granny Flats
Granny flats are one of the most CDC-friendly build types in NSW. Most granny flats qualify for fast-track CDC approval:
**CDC pathway (recommended — most common):** • Timeframe: 10–20 business days • Cost: $3,000 – $5,000 • Available if: Your granny flat meets all prescriptive standards in the Codes SEPP • No neighbour notification required • Assessed by private accredited certifier
**DA pathway (when CDC doesn't apply):** • Timeframe: 40–90 days • Cost: $5,000 – $10,000 • Required if: Property is flood-prone, heritage-listed, bushfire-prone (BAL-40+), or doesn't meet CDC setback/height standards • Neighbour notification required • Assessed by local council
