Once your DA or CDC is determined, construction can't start until a Construction Certificate (CC) is issued. And your building can't be occupied until an Occupation Certificate (OC) is granted. Between those two milestones, multiple critical-stage inspections must be scheduled, passed, and documented.

Key Certificates in a NSW Build — CC, OC & What Each Means
Construction Certificate (CC)
Issued before any building works begin. The CC certifies that your plans comply with the development consent (DA or CDC) and the National Construction Code (NCC). No construction can legally commence without a valid CC. Issued by a private certifier.
Occupation Certificate (OC)
Issued after the final inspection, confirming all stage inspections have passed and the building is safe to occupy. You cannot legally move into a new home without an OC. The certifier conducts a final inspection and verifies all conditions of consent have been satisfied.
Compliance Certificates
Issued at each mandatory inspection stage during construction. These confirm that the work completed to that point complies with the approved plans and the NCC. All compliance certificates must be in order before the OC can be issued.
Mandatory Inspection Stages
NSW building legislation requires certifier inspections at critical construction stages. Buildana coordinates all inspections and ensures every stage passes before the next one proceeds.
Footings & Slab
Inspected before concrete is poured. Certifier checks reinforcement, formwork, plumbing rough-in, and vapour barrier against engineering drawings.
Frame
Inspected after frame is complete but before internal cladding is applied. Checks structural compliance, bracing, tie-downs, and window/door openings.
Waterproofing
Inspected after membrane is applied in wet areas. Must comply with AS 3740. Failure at this stage is classified as a major defect — covered by the 6-year structural warranty.
Final
Full inspection before OC is issued. Certifier confirms all stage inspections passed, conditions of consent met, and building is safe and compliant for occupation.
Compliance Frameworks That Apply to Every Build
NCC 2022 Compliance
Structural integrity (engineer-certified), fire safety (smoke alarms, fire separation), energy efficiency (7-star NatHERS minimum), accessibility (Part D), and health/amenity (ventilation, natural light). All mandatory.
BASIX Certificate
Mandatory for all new residential builds over $50,000 in NSW. Covers energy efficiency (star rating), water efficiency (rainwater, fixtures), and thermal comfort. Must be obtained before CC is issued.
Home Building Compensation (HBC)
Mandatory insurance for all residential building work over $20,000 in NSW. Covers homeowners if the builder becomes insolvent, dies, or disappears. Buildana holds current HBC coverage.
6-Year Structural Warranty
Under Home Building Act 1989 s18B: 6 years for structural defects, 2 years for non-structural defects. Cannot be contracted out of. Claim path: Buildana first → Fair Trading NSW → NCAT.
