The Housing SEPP 2021 (formerly the Affordable Rental Housing SEPP) sets out the planning rules for boarding house developments in NSW. It specifies which zones permit boarding houses, room size requirements, car parking, and other development standards. Boarding houses are permissible in R1, R2, R3, R4, B1, B2, and B4 zones, among others.

Room limits depend on zoning. In R2 Low Density zones, developments are typically limited to 12 rooms. In R3 Medium Density, up to 20 rooms. In R4 and B2 zones, 30+ rooms are possible — subject to FSR, height limits, and council-specific controls. Each room must be at least 12sqm.

Boarding houses can generate strong rental yields — typically 7–10% gross on total project cost — due to higher per-room income compared to standard residential. However, they require DA approval, higher management costs, and compliance with fire safety and accessibility standards.

Boarding houses require a Development Application (DA) — they cannot use the CDC fast-track pathway. You'll need architectural plans, a traffic study, fire engineering report, BCA compliance report, and accessibility statement. Approval timelines range from 3–12 months depending on council.
